Terms & conditions of enrolment

These terms are a working draft pending adoption by [COMMITTEE NAME] on [DATE]. Amounts, percentages and time limits shown in this style — [XX] — are placeholders and must be confirmed by the college before they are relied upon. Nothing in these terms removes any right you have under the general law, and no term should be read as doing so.
These terms apply to the relationship between SCMAT UK — UK College of Chinese Medicine & Acupuncture Techniques (“the college”, “we”) and each person enrolled on one of its programmes, short courses or CPD events (“the student”, “you”). Part A governs enrolment and study. Parts B and C govern this website and the general law of the contract. If you are considering an application and something here is unclear, ask us before you accept a place — that is what the college office is for.
Part A · Enrolment
1. How a contract is formed
An application is an invitation to us to consider you; it is not itself an offer of a place, and no contract exists at that point. A contract is formed when all three of the following have happened:
- the college makes a written offer of a place, setting out the programme, the start date and the fee position;
- you accept that offer in writing, or by paying the deposit or enrolment fee we have asked for; and
- any conditions attached to the offer have been met — for example evidence of a prior qualification, a satisfactory reference, or completion of a DBS check where the programme requires one ([LIST ANY CONDITIONS FOR EACH PROGRAMME]).
We may withdraw an offer before a contract is formed if information you have given us turns out to be materially inaccurate, if a condition is not met, or if a programme does not recruit enough students to run. If we withdraw an offer we refund anything you have paid us in respect of that programme, in full.
Where a programme does not reach its minimum number, we will tell you by [DATE OR NUMBER OF WEEKS BEFORE THE START] and will offer you a place on an alternative programme or a full refund.
A contract for a short course, workshop or event is formed in the same way, on the same terms, unless the booking confirmation says otherwise.
Part A · Enrolment
2. Enrolment and student status
You are responsible for the accuracy of the information in your application. If a qualification, reference or declaration turns out to be false or misleading, the college may withdraw the offer or terminate your enrolment.
Enrolment is personal to you. It does not create any right to teach, to describe yourself as a graduate of the college before an award is conferred, or to use the college’s name in advertising.
The college may make reasonable changes to a programme — to module order, to timetabling, to reading lists, or to the tutor delivering a session — provided the overall learning outcomes are not materially diminished. Where a change is material, we will tell enrolled students in writing at least [XX] days beforehand and will explain the alternatives, including the option to transfer or to withdraw with a refund of fees for teaching not yet delivered.

3. Fees and payment
The college publishes fees on enquiry rather than as a table on this website. A written quotation will set out what the fee covers; it is confirmed with your offer and forms part of the contract. Nothing on this website is a quotation or an offer of a specific fee.

4. Cancellation and refunds
Your statutory right to cancel. If you enrolled at a distance — online, by post or by telephone — or away from our premises, you normally have the right to cancel within 14 days of the contract being formed, and to receive a full refund. You do not need to give a reason. To cancel, write to admissions@scmat.org.uk before the 14 days have passed. If teaching has already begun at your request during that period, we may deduct a proportionate amount for what has been delivered.
Beyond the statutory cancellation period, refunds are made according to the schedule below. The percentages are placeholders pending confirmation.

Refunds are made to the person or organisation that paid, by the original method where possible, within [XX] working days of a refund being agreed. Where fees are paid by instalments, any refund is calculated against the total fee, not against the instalments paid to date.
Your statutory rights
Nothing in this section, or anywhere else in these terms, excludes or limits any right you have under consumer law. Where a term of this contract conflicts with your statutory rights, your statutory rights prevail.
Part A · Enrolment
5. Withdrawal, interruption and deferral
To withdraw, write to the college office. Withdrawal takes effect on the date we receive your written notice, not the date you stopped attending, and fee liability is calculated from that date.
Where illness, caring responsibilities or another serious circumstance interrupts your study, you may apply to interrupt for an agreed period. An interruption preserves your place and your completed assessments, subject to [MAXIMUM INTERRUPTION PERIOD]. Any clinical hours completed remain recorded.
Deferral to a later intake is at the college’s discretion and depends on the programme running and on places being available. A deferral may carry an administration charge of [AMOUNT], and the fees for the later intake will be those in force at the time. Deferral beyond [MAXIMUM PERIOD] normally requires a fresh application.
If you hold a student visa, tell us before withdrawing, interrupting or deferring — the college may have reporting duties to UK Visas and Immigration. [CONFIRM VISA SPONSORSHIP STATUS]
Part B · Conduct
6. Student obligations
Enrolling creates obligations as well as rights. By accepting a place you agree to the following.

| Attendance and engagement | Attend at least [XX]% of taught sessions, and all assessed practical sessions. Persistent absence without explanation may lead to a review of your place on the programme. |
| Academic integrity | Submit your own work. Plagiarism, collusion, impersonation in an examination, and the fabrication of clinical hours or case records are serious matters and are dealt with under the college's academic misconduct procedure. |
| Conduct | Treat staff, fellow students and patients with courtesy. Behaviour that is discriminatory, intimidating or unsafe is investigated and may lead to exclusion. |
| Clinical protocols | Follow the college's health and safety, infection prevention, sharps and consent protocols without exception. Students who cannot do so safely will not treat patients. |
| Fitness to practise | Tell the college promptly about any change in your health, or any caution, conviction or professional restriction, that affects your ability to practise safely. This is a professional duty, not a trap. |
| Confidentiality | Keep patient information confidential. Clinical material used in teaching is anonymised, and must not be shared outside the college. |
| Recording and materials | Do not record teaching sessions, or circulate teaching materials, without written permission from the college. |
| Contact details | Keep your address, telephone number and email address up to date. Notices sent to the last address you gave us are treated as received. |
Part B · Conduct
7. What the college undertakes
The college will deliver teaching with reasonable care and skill, by staff competent in the subject; assess you fairly against published criteria; supervise clinical practice properly; tell you about material changes to your programme; provide access to the complaints and appeals procedures; and hold professional indemnity and public liability insurance covering the college’s own activities — [INSURER AND COVER SUMMARY].
The college does not guarantee a particular examination result, a placement, employment, or registration with any professional body. Where a programme is not yet accredited by a particular body, we will say so plainly rather than implying otherwise.
Part C · General
8. Intellectual property
Copyright in teaching materials — handouts, slides, recorded lectures, course notes, assessment papers and the contents of the virtual learning environment — belongs to the college or to the tutor who created it. Enrolled students receive a personal, non-transferable licence to use those materials for their own study during the programme. They may not be sold, published, uploaded to a file-sharing service or used to teach others.
You own the copyright in work you create for assessment. You grant the college a licence to copy, store and share that work for assessment, moderation, external examining, quality assurance and academic appeals. We will not publish your work or use it in marketing without your written consent.
The college’s name, crest and logo may not be used by students, graduates or member organisations without written permission. Describing yourself factually as a graduate or a member is fine; implying that the college endorses your practice is not.
Part C · General
9. Liability
Nothing in these terms excludes or limits the college’s liability for death or personal injury caused by its negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be excluded.
Subject to that, the college is not liable for indirect or consequential losses — including loss of earnings, loss of opportunity or loss of anticipated profit — however they arise, and its total liability in connection with a student’s enrolment is limited to [CONFIRM — e.g. the fees paid by that student for the academic year in which the claim arises]. The college is not liable for loss caused by events outside its reasonable control, such as industrial action, extreme weather, power failure, epidemic disease or the closure of a venue.
Where teaching is cancelled for a reason within the college’s control, the college will reschedule it or refund the fee for the session not delivered.

10. Website terms
This website is provided for information. We take care to keep it accurate, but programme details, dates, venues and staffing change, and the definitive position is always the written offer or the programme handbook. Nothing on this website is a contractual offer, a quotation of fees, or advice for an individual.

You may read, print and share pages for personal or educational use. You may not copy the site wholesale, scrape it, reuse it commercially, or present its content as your own. Links to other websites are provided for convenience; we do not control them and are not responsible for their content.
We aim to keep the site available, but we do not guarantee uninterrupted access. Because it is served as static files, there is no user account, no payment and no booking system on it.

11. Governing law and jurisdiction
These terms, and any dispute arising out of them, are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction. If you live in Scotland or Northern Ireland, this does not remove any right you have to bring proceedings where you live.
Before any legal step, please use the college’s complaints and appeals procedure. It is faster, free and designed to resolve the problem. Where an awarding body or the Office of the Independent Adjudicator has jurisdiction, their route is explained in that procedure.
The college may vary these terms for future intakes. Students already enrolled are told in writing about any change that affects them, and no change is applied retrospectively to fees already paid.
